The Independent National Electoral Commission, INEC, had announced Udende as the winner of the senatorial election.
The former Governor of Benue State, Gabriel Suswam, has been sacked from the Senate by the Court of Appeal sitting in Abuja.
The Court on Wednesday affirmed Emmanuel Udende of the All Progressives Congress (APC) as the winner of the Benue North East senatorial seat of Benue state.
The verdict was delivered by Justice Abimbola Osarugue Obaseki Adejumo, who led the panel.
The Independent National Electoral Commission, INEC, had announced Udende as the winner of the senatorial election.
However, Suswam filed a petition at the Benue State National Assembly Election Petition Tribunal to challenge Udende’s victory.
According to the former governor, the election was marred by irregularities and falsification of results, among others.
The tribunal subsequently ruled in favour of Suswam and Udende and APC appealed against the judgment at the Appeal Court.
The appellate court, in a unanimous decision by a three-member panel of Justices, said it was satisfied that Suswam did not win the senatorial election.
It faulted the judgement of the tribunal which nullified the victory of Udende.
The Court of Appeal therefore set aside the judgement of the tribunal and returned the Appellant (Udende) as the winner of the Benue North East senatorial election that was held on February 25.
